Welcome to Buoy. These Terms of Use ("Terms") are an agreement between you and Buoy ("Buoy," "we," or "us") governing your use of the Buoy mobile app.

You must be at least 18 years old to use Buoy. By using the app, you confirm that you are 18 or older and that the information you provide is accurate. You're responsible for keeping your account secure and for activity that occurs under your account.
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to use Buoy for your own non-commercial use, in line with these Terms. You may not copy, modify, reverse-engineer, resell, or attempt to extract the source code of the app, except where the law expressly permits it.
Except for content you or other users provide, Buoy and its licensors own all rights, title, and interest in the app, including its software, design, trademarks, and other intellectual property.
You own the content you create on Buoy — your buoys, plans, group names, and profile details. By posting, you grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content, and to share it with the people and groups you choose, for the purpose of operating, providing, securing, and improving Buoy. This license includes the right to permit our service providers to process your content on our behalf.
The license ends when your content is deleted, except for limited copies retained in backups or as reasonably necessary for legal, safety, or security purposes. You're responsible for the content you post and confirm you have the right to share it.
Buoy does not permit objectionable content or abusive behavior.
When using Buoy, you agree that you will not post, share, or engage in any content or conduct that:
You also agree not to use Buoy to stalk, harass, or harm other people, and not to misuse other people's personal information, including contact details you encounter through the app.
We give you tools to keep your experience safe. You can report objectionable content or accounts and block other users directly in the app. We review reports of objectionable content and may take appropriate action, including warning users, restricting or removing content, and suspending or permanently terminating accounts.
We may remove content or terminate any account that we determine violates these Terms, with or without prior notice. By using Buoy, you agree to these enforcement measures.
You agree to use Buoy only for its intended purpose — coordinating real plans with people you know. You will not use automated systems to access the app, scrape data, create fake accounts, or interfere with the app's normal operation or other users' enjoyment of it.
You can delete your account at any time from within the app. Account deletion permanently deletes your account and associated personal data and user content, except information we are required or permitted to retain for legal, safety, security, fraud-prevention, or dispute-resolution purposes, as described in our Privacy Policy.
We may suspend or terminate your access if you violate these Terms or use Buoy in a way that could harm Buoy, its users, or others. We may also suspend or terminate your access at any time, for any reason or no reason, with or without notice, to the extent permitted by law. On termination, your right to use the app ends immediately.
Buoy uses third-party services to operate. Place search is powered by Google Maps Platform, and your use of those features is also subject to the Google Maps Platform Terms of Service and the Google Privacy Policy. Your use of the app is also subject to the terms of the app store from which you obtained it.
Buoy is provided "as is" and "as available," without warranties of any kind, whether express or implied, to the fullest extent permitted by law. We don't guarantee that the app will always be available, uninterrupted, secure, or error-free.
Plans made through Buoy are between you and the other people involved. Buoy does not verify users' identities or supervise meetings, and you are responsible for your own safety and judgment when meeting others.
To the fullest extent permitted by law, Buoy will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or related to your use of the app.
To the fullest extent permitted by law, Buoy's total liability arising out of or relating to the app or these Terms will not exceed the greater of $100 or the amount you paid to Buoy during the twelve months preceding the event giving rise to the claim. Where liability cannot be excluded or limited by law, it is limited to the maximum extent permitted.
We may update Buoy and these Terms over time. When we make material changes to the Terms, we'll update the "Last updated" date and provide notice where appropriate. Continuing to use Buoy after changes take effect means you accept the updated Terms.
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. You and Buoy agree that any dispute arising out of or relating to these Terms or the app will be brought exclusively in the state or federal courts located in New York County, New York, and you consent to the jurisdiction of those courts, unless applicable law requires otherwise.
